Question
BH, Shalom Rabbi, my family and I are moving into a new home soon and we would like to place a mezuzah on our door. However, we do not want people to know Jews live there. Since Oct 7, our country (Spain) has gotten more antisemitic and anti-Israel than before, and Jews have become a target for violence and harassment. So, halachically, is it possible to place the mezuzah after the doors frame? Thank you.
Answer
Thank you for your important question. In your situation where it is dangerous to have a Mezuza outside you should put the Mezuza on the inner side of the door. Here we need to describe a few possibilities: 1. If there is a place for you to put the Mezuza on the actual width of the entrance, then this is preferable. According to some Poskim this would even require a Bracha, although since many Poskim say not to recite a Bracha in this case, you should refrain from making a Bracha. 2. Option number #1 is usually not a very practical solution; since most of our house door hinges shut in a way that do not leave any surface left for a Mezuza. Therefore, in this case you should put the Mezuza on the inner wall of your house, less than a Tefach from the entrance. In this case, obviously, you do not recite the Bracha. 3. A good and practical solution for you, if you want to recite a Bracha, is to install a Mezuza in a bedroom inside your home that is 'Chayav' for a Mezuza (large enough - 4 by 4 Amos) and then make a Bracha on that room together with installing the one at the entrance to your home on the inner side of the door. All the Best. Explanation: The Torah commands us to put a Mezuza on our doorpost (Dvarim 6, 9). The Gmara writes that a Mezuza "Behind the door is not a Mitzva" (Menachoss, 32:b). It is argued what exactly is "behind the door", and what exactly does it mean "not a mitzvah". According to some Rishonim this means that it is not a Mitzva at all (Rambam and Nimukei Yosef, brought by the Bet Yosef). Others say that it still considered a Mitzva only on a 'Bidieved' level (The Tur, brought by the Rema). The Shach on Shulchan Aruch,( Yoreh deah, 289, 2) brings the 'Ma'adanei Yom Tov' who writes that, when it is dangerous, one may rely on the Tur's and the Rema's ruling, and put the Mezuza on the inner side of the door. We do find others that brought this 'Hetter' (see Aruch Hashulchan, Siman 289, 13-14. Chayei Adam, Chelek Alef, Klal 15, Halacha 21). Although we find that one could rely on the Shach, we see in some of the Poskim that this should be done without reciting the Bracha. (Nishmass Avraham. Chovat Hadar. Pitchei Shearim). This all refers to putting a Mezuza in the actual width of the door. If it is on the inner wall of the house this is preferable, and apparently all poskim will say that this is not the Mitzva.
