Question
My air conditioner unit is next to my neighbor’s bedroom window. During the summer, they have complained the noise disturbs their sleep. They claim if they close their window, their room will be too warm. They too have an air conditioner, just not in the bedroom. Various technicians have all told me the unit is working fine and the sound coming out is in the normal range. I have tried to be considerate and not used it at night. But now they want it off during their afternoon rest between 14:00 - 16:00. I am disabled and do not work, so I am home most of the time.
Answer
If your air conditioner was installed far enough from your neighbor’s bedroom window in accordance with the law (the law can be found in the Israel Ministry of Environmental Protection website), and the noise it makes, was tested, and is also in accordance with the law, you may be allowed to keep your air conditioner on, even if it disturbs your neighbor. Nevertheless, the right thing to do is to try and come up with a solution which will satisfy both parties. Perhaps you can move the outdoor unit of the air conditioner to another location where it won’t disturb anyone and you will be able to use it freely. If you cannot find a solution yourself, consider bringing over a local Rabbi or Rabbinical judge to help you find a peaceful solution.
